1. Parties and Acceptance. These Terms of Sale — the "Terms" — are a binding agreement between you, the purchaser, and [Company Legal Entity], doing business as Forever Living Kenya, with its principal place of business at [Company Address] — the "Company," "we," "us," or "our." By placing an order through https://forever-living-kenya.fluid.app, a Company mobile application, or an independent distributor's replicated site — collectively, the "Store" — you accept these Terms. If you do not agree, do not place an order. These Terms incorporate by reference our Privacy Policy, Return and Refund Policy, and — for recurring orders — the Subscription and Auto-Renewal Disclosure.
2. Eligibility. You must be at least eighteen years old — the age of majority in Kenya — and able to form a binding contract. Purchases are for personal or household use — purchases for resale are governed by the Member Agreement, not these Terms.
3. Products and Descriptions. We take reasonable care to describe products accurately, including ingredients, materials, dimensions, and images. Minor variations — for example, screen color rendering — are not a nonconformity. Nothing in the Store is medical advice — wellness products and supplements are not intended to diagnose, treat, cure, or prevent any disease, and product representations comply with the Consumer Protection Act 2012 prohibition on false or misleading representations.
4. Ordering and Order Acceptance. Your order is an offer to purchase. We accept it when we send an order confirmation or, if earlier, when we dispatch the goods. We may refuse or cancel any order in whole or in part before dispatch — including for suspected fraud, pricing or description errors, or quantity limits — and will refund any amount already charged for the cancelled portion. If we cancel for a pricing error, we will notify you and offer the correct price.
5. Pricing, VAT, and Electronic Tax Invoices. All prices are stated in Kenya Shillings — KES — and are inclusive of Value Added Tax at the standard rate of sixteen percent. The VAT component is shown on your receipt. For every order we issue a KRA-validated electronic tax invoice through eTIMS, as the Tax Procedures Act electronic-invoicing regime requires, and deliver it to your email address. Delivery charges, if any, are displayed before you confirm payment. Prices may change at any time, but changes do not affect orders we have already accepted.
6. Payment. We accept the payment methods displayed at checkout. By submitting payment credentials you confirm you are authorized to use them and you authorize us and our payment processors to charge the total order amount. Card payments are processed with strong customer authentication — 3-D Secure — where the issuer supports it. Payment card data is handled by PCI DSS-compliant processors — we do not store full card numbers. If a payment is declined or reversed, we may suspend fulfilment until resolved.
7. Delivery. We deliver to addresses in Kenya using couriers and last-mile riders. Because rider delivery is phone-first, you must provide a working mobile number — the courier will call or message to coordinate handover. We will dispatch within the time stated at checkout or, if none is stated, within thirty days of order acceptance. If we cannot dispatch on time, we will notify you of the delay and the revised date and offer you the choice of accepting the delay or cancelling for a full and prompt refund. Delivery dates given by carriers are estimates.
8. Risk and Title. Title and risk pass to you on delivery of the goods to you or your nominated recipient. We will assist with claims for shipments lost or damaged in transit — contact [Support Email] and we will replace or refund verified transit losses.
9. Returns, Refunds, and Cancellation Rights. Returns and refunds are governed by our Return and Refund Policy, incorporated into these Terms. In addition, for direct sales agreements — sales concluded in person away from the seller's permanent place of business, such as at a home presentation or event hosted by an independent distributor — you may cancel within ten days under Part VI of the Consumer Protection Act 2012, as described in the Return and Refund Policy.
10. Statutory Guarantees. Goods must correspond with their description and be of merchantable quality and fit for purpose under the implied conditions of the Sale of Goods Act, Cap 31, and the Consumer Protection Act 2012 gives you remedies of repair, replacement, or refund for goods that fail to meet those standards. Nothing in these Terms excludes, restricts, or modifies rights that cannot be excluded under Kenyan law — any limitation in these Terms applies only to the extent the law permits.
11. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER, AND NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSS. THIS LIMITATION DOES NOT APPLY TO PERSONAL INJURY CAUSED BY A DEFECTIVE PRODUCT, TO FRAUD OR WILLFUL MISCONDUCT, OR TO ANY LIABILITY THAT CANNOT BE LIMITED UNDER KENYAN LAW, INCLUDING YOUR STATUTORY REMEDIES UNDER THE CONSUMER PROTECTION ACT 2012.
12. Dispute Resolution. Contact us first at [Support Email] — we will attempt in good faith to resolve any dispute within thirty days. Unresolved disputes may, at your election, be referred to the Small Claims Court for claims within its monetary limit under the Small Claims Court Act 2016, or resolved by arbitration in Nairobi under the Arbitration Act 1995 before a single arbitrator, or brought before the competent Kenyan courts. Nothing in this Section prevents you from complaining to the Competition Authority of Kenya or the Kenya Consumers Protection Advisory Committee.
13. Governing Law. These Terms are governed by the laws of Kenya, without displacing consumer protections that apply mandatorily in Kenya.
14. Changes, Severability, Entire Agreement. We may revise these Terms prospectively by posting an updated version at https://forever-living-kenya.fluid.app — the version in effect when you place an order governs that order. If any provision is held unenforceable, the remainder stays in effect. These Terms, with the documents they incorporate, are the entire agreement regarding your purchase.
